Yahoo! Information Corporation Taiwan Branch, Fubon Media Technology Co., Ltd. (8454) and Anborteh Industrial Co., Ltd. Sold steering wheel cover products on the Yahoo! Kimo Shopping Center website, and Momo shopping website, and the advertisements stated that the products were produced in Taiwan, but in fact they were produced in China, which involved in untrue advertisements and violated the provisions of Article 21(1) of the “Fair Trade Act”, and imposed a fine of $100,000 on Anborteh Industrial Co., Ltd., and a fine of $50,000 on each of Yahoo! Information Corporation Taiwan Branch and Fubon Media Technology Co., Ltd.

According to the Fair Trade Commission, the advertisements claimed that the origin of the product is Taiwan, which made consumers believe that the products were made in Taiwan or originated from Taiwan. Since consumers have different levels of trust due to the difference in the place of manufacture or origin of the products, the place of origin of the products is often an important reference factor that affects their trading decisions.

This case is based on the supplier Anborteh Industrial Co., Ltd. admitted that the origin of the products was originally Taiwan, but was later changed to China for some reason. Due to an omission, the origin information contained in the advertisements was not synchronized and updated, and therefore the advertisement claimed to mislead people into believing that the origin of the products was Taiwan, which is a false, untrue, and misleading representation, and is in violation of the aforementioned provisions of the Fair Trade Act.

The Fair Trade Commission reminds businesses that if the origin of a product has changed, it should review and amend the content of the product’s advertisement to ensure that the product’s relevant information is consistent with the actual situation, in order to protect the rights and interests of consumers and avoid violating the law.
