U.S. communications chip giant Qualcomm has sued Chinese smartphone manufacturer Transsion Holdings in an Indian court, alleging infringement of four of its non-standard essential patents. Transsion has stated that it has signed a 5G standard patent licensing agreement with Qualcomm, is complying with the agreement, and will continue to negotiate with third parties to determine a reasonable licensing fee.
According to a report from the Securities Times, Qualcomm issued a statement saying that Transsion used Qualcomm’s patented technology in its products, becoming one of the top five global smartphone manufacturers by sales. Qualcomm mentioned that while Transsion recently signed a licensing agreement with Qualcomm for some products, the vast majority of its products have not yet been licensed by Qualcomm.
Transsion originally built its business on feature phones and low-end phones in overseas markets such as Africa but has recently increased its share of smartphones.
Qualcomm continues to hold a strong position in the high-end smartphone SoC (system-on-chip) market. As Transsion has gradually entered the mid-to-high-end smartphone market in recent years, its interactions with Qualcomm have become more frequent.
The responses from both Transsion and Qualcomm reveal the underlying conflict: Transsion believes Qualcomm’s patent fees are excessively high, while Qualcomm believes that Transsion has infringed upon its patent portfolio. According to foreign media IP Fray, Qualcomm’s choice to litigate in India highlights the growing importance of India as a venue for patent enforcement.
