TSMC Accused of Patent Infringement: Vows to Defend Its Technology Against Patent Trolls

Liberty Times e-News, August 6, 2024
[Reporter Hung You-Fang, Hsinchu] TSMC (2330) responded firmly today to a patent infringement lawsuit filed by AICP, a company registered in the United States, in the U.S. District Court for the Eastern District of Texas last Thursday (1st). The lawsuit accuses TSMC of infringing on seven integrated circuit-related patents. TSMC stated that this case is a typical example of a patent troll, or Non-Practicing Entity (NPE), initiating legal action. The company emphasized that the case has entered legal proceedings, and TSMC will defend its technology through the judicial process.
TSMC noted that it is a technological leader in the semiconductor industry, investing billions of dollars annually to independently develop industry-leading patented technologies. In 2023 alone, TSMC invested $5.8 billion (approximately NT$189.2 billion).
According to foreign media reports, AICP claims that TSMC has infringed its patents by manufacturing HMP products for Freescale (now NXP), 28nm process products for MediaTek (2454), and FinFET products using 5nm, 7nm, 10nm, and 16nm processes for Apple’s A15 Bionic chip. AICP has filed six patent infringement claims related to TSMC’s 28nm process and one claim related to its FinFET process.
In a statement released this evening, TSMC reiterated that the lawsuit was initiated by a patent troll, a Non-Practicing Entity (NPE). The case has entered legal proceedings, and the company will defend its technology through the judicial process.
