Japanese LED giant Nichia has filed a new patent infringement damages lawsuit against Taiwanese LED manufacturer Everlight Electronics (2393) and its German subsidiary at the Düsseldorf District Court in Germany, requesting compensation of 2.5 million EUR (approximately NTD 93.65 million). The lawsuit is mainly based on two final judgments that the court had previously made against Everlight.
Everlight responded that it was the amount Nichia unilaterally claimed and it had not yet been finalized; Everlight also emphasized that among the lawsuits in many countries around the world, only the German court made the judgment.
It is understood that both previous judgments involved key YAG patents owned by Nichia. In one of the two judgments, the court clearly determined that Everlight had infringed the patent; in the other judgment, Everlight acknowledged all the claims made by Nichia. Nichia pointed out that Everlight originally refused to provide complete account books for products outside the judgment, however Everlight finally submitted them after Nichia filed for enforcement and the court supported it. Based on the account books, Nichia calculated that the reasonable amount of compensation is 2.5 million EUR and has now initiated proceedings to request compensation.
