Recent litigation updates from the Unified Patent Court (UPC) Mannheim division reveal that MediaTek’s subsidiary HFI Innovation has filed a lawsuit against five Huawei subsidiaries for infringing European patent EP2689624. Industry observers view this as MediaTek’s further response to Huawei’s earlier patent infringement claims, indicating an intensifying patent battle between the two companies.

In response, MediaTek stated yesterday (June 23), “This is a development of the same matter.”

According to MediaTek’s annual report, Huawei and related companies filed several telecommunications technology patent lawsuits in May last year at the Shenzhen Intermediate People’s Court in China, alleging MediaTek’s infringement of Chinese patents. Huawei and related entities also initiated patent lawsuits in August at the Shanghai Intellectual Property Court, Guangzhou Intellectual Property Court, and Hangzhou Intermediate People’s Court, asserting infringement of Chinese patents by MediaTek. Last year, MediaTek also filed patent litigation against Huawei in a UK court but did not disclose further details. It is understood that the patent MediaTek claims involves an LTE technology titled “Method for Search Space Configuration of Enhanced Physical Downlink Control Channel.”

The patent dispute between Huawei and MediaTek began in 2022. In March 2022, Huawei approached MediaTek seeking royalty payments for its 5G standard essential patent portfolio, but negotiations failed. MediaTek rejected the offer, citing terms that did not meet Fair, Reasonable, and Non-Discriminatory (FRAND) conditions. Following unsuccessful talks, Huawei filed patent infringement lawsuits against MediaTek in May 2024, potentially covering 5G (and possibly 4G, 3G, etc.) cellular mobile communication technologies, and simultaneously initiated lawsuits in Shenzhen, Guangzhou, and other locations concerning infringement of key 4G and 5G patents.

MediaTek swiftly countered. In July 2024, MediaTek and its subsidiaries HFI Innovation and MTK Wireless filed lawsuits against Huawei in a UK court, accusing Huawei of infringing three of their 4G/5G patents and seeking injunctions.
