Netjoy LTD, which operates the mobile application Huange APP, has been accused of infringing on 518 songs from multiple record labels, including JVR Music, B’in Music, Rock Records, and Linfair Records, without obtaining authorization. The tracks involved include works by well-known artists such as Jacky Cheung and Mayday. After receiving the report, the Criminal Investigation Bureau referred company CEO Chen Zhiyu and Marketing Director Zhang to prosecutors. The Taipei District Prosecutors’ Office concluded its investigation today, determining that Chen and Zhang had violated the Copyright Act and formally indicted both individuals.
According to the investigation, Netjoy LIMITED is the Taiwan agent of MAXBROS LIMITED, a Hong Kong-based company, and is responsible for operating Huange APP. Mr. Chen serves as the CEO of the company, while Mr. Zhang is responsible for marketing campaigns and business negotiations.
Despite knowing that 518 songs owned by various record labels were not authorized for use, the two defendants reproduced these songs without permission and uploaded them onto Huange APP, making them available for public browsing and downloading, thereby infringing on the copyrights of the record companies.
The songs involved include works by Mayday, A-Mei, Jacky Cheung, Jam Hsiao, Stefanie Sun, Na Ying, Steve Chou, Claire Kuo, and other popular artists.
Following interrogation, the prosecutor concluded that Chen and Zhang not only reproduced the songs but also distributed them through public transmission, resulting in illegal profits exceeding NT$30.82 million. They were indicted under Article 92 of the Copyright Act for unauthorized public transmission infringing on the economic rights of another person. The prosecutor also requested the court to confiscate more than NT$4 million that had been seized.
