Everlight Electronics Co., Ltd. (TWSE: 2393) is defending its intellectual property rights. The company announced in a material information disclosure yesterday (the 3rd) that it formally filed a patent infringement lawsuit on February 2 (U.S. time) with the United States District Court for the District of Delaware, accusing LED component manufacturer Lumileds LLC of infringing its U.S. Patent No. 7,554,126.
According to Everlight Executive Vice President Hung Yen-yen, certain automotive LED products and high-power LED products sold by the defendant are alleged to infringe Everlight’s patent rights. Everlight has therefore petitioned the court, in accordance with applicable law, to order the defendant to cease the infringing acts and to assume liability for damages.
Everlight further explained that the core technology at issue in this dispute relates to LED flip-chip and packaging processes. By adjusting the area ratio of the N-type and P-type electrodes, good adhesion between the LED chip and the solder can be ensured, thereby achieving high thermal dissipation performance and packaging reliability. This technology constitutes a key enabling technology for the high-end automotive lighting market. Everlight reiterated that it will not tolerate any unlawful infringement activities in the market. To date, the company has secured multiple key patents in regions including the United States, China, Japan, Europe, South Korea, and Taiwan, and will continue to deepen its intellectual property portfolio to strengthen its competitive position.
With respect to the impact of the litigation, Everlight stated that, based on a preliminary assessment, the lawsuit has not yet had a material impact on the company’s financial condition or operations. Any future impact will depend on the progress of the litigation.
Industry analysts note that Everlight’s decision to initiate litigation in the United States indicates that its strategic positioning in the high-end automotive LED market has entered a harvest phase, and that the company is using legal measures to further reinforce its competitive advantages.
