IC design house ILI Technology Corp. (6962) announced on the 25th the first-instance court ruling regarding the patent infringement lawsuit filed against it by ELAN Microelectronics Corp., stating that ILI has won the case.
The case stems from ELAN (2458) filing a lawsuit with the Intellectual Property and Commercial Court on December 17 last year against ILI’s subsidiary, ILI Technology, and distributor NeoView Technology. ELAN alleged that the capacitive touch chips manufactured and sold by ILI Technology infringed upon its R.O.C. Invention Patent No. I380207, seeking an injunction against the infringement, damages, and other remedies.
The first-instance ruling dismissed both the plaintiff’s claims and its application for provisional execution. Additionally, legal costs are to be borne by the plaintiff. ILI stated that the verdict has no impact on the company’s finances or business operations. If the plaintiff decides to appeal, ILI will consult with its appointed legal counsel to proceed with further legal procedures in accordance with the law to protect the company’s rights and interests.
Meanwhile, ELAN announced that it was notified by its legal counsel of the Intellectual Property and Commercial Court’s first-instance judgment dismissing the plaintiff’s claims and application for provisional execution. As the plaintiff, ELAN is not liable for any damages under this ruling, and it will have no material impact on the company’s financial condition or business operations. Once the official judgment document is received, ELAN will discuss with its legal counsel to take actions that are most advantageous to the company.
