Extend the scope and time period allowable to file a divisional application after granted (entered into force on November 1, 2019)
Prior to this amendment of Taiwan Patent Law, divisional filing is only applicable to an invention application granted within 30 days that the approval notice of examination is received. This amendment looses the 30 days period to 3 months and the divisional filing is applicable not only to the approval notice of examination but also to the approval notice of reexamination. In addition, a granted utility model application is also applicable.
Transitional provision for patent applications division after approval decisions:
Any approval notice received within 3 months and received after this amendment should applicable.
Divisions A, B and C are all applicable.
